Amanda Smith of Pennsylvania was arrested and detained for three days because a Cash App account opened in her name was used in an Arkansas online sales scam; she says she was a victim of identity theft. According to 404 Media and a post discussing its reporting, parts of the account’s address, phone number, and device information differed from hers. The company declined to provide records because she could not prove account ownership, and the records were obtained through criminal proceedings. The reported maximum of six years is a possible sentence associated with the charges, not a sentence already imposed. The case remains ongoing, with a hearing scheduled for November.

An account containing a person's identifying information does not by itself establish who opened it or conducted its transactions.
